CNJ: DJEN and DJE definitely mandatory from 05/16/2025

In compliance with the guidance of the National Council of Justice (CNJ), due to the rules provided for in CNJ Resolutions No. 455/2022 and No. 569/2024, all procedural deadlines, starting last Friday, May 16, 2025, are being counted based exclusively on publications made in the National Electronic Official Gazette (DJEN) or, when the communication is personal, through the Electronic Judicial Domicile (DJE), official platforms for the publication of judicial acts of the Judiciary.

 

As determined by art. 12 of Resolution No. 455/2022 of the CNJ, “The DJEN replaces the current electronic justice diaries maintained by the bodies of the Judiciary and will be available on the Services Portal and on the CNJ website on the world wide web.”

 

Under the terms of art. 11, §2, of the same Resolution, publications made in the DJEN will also replace any other means of official publication for purposes of subpoena, “except in cases where the law requires personal inspection or subpoena”.

 

Prior to this change, each institution still had its own procedural communication system, which created differences and made it difficult to monitor deadlines. From now on, general summonses are being made through the DJEN, which is the official channel to start counting deadlines.

 

Only in cases where the law requires personal communication will the DJE be used, which is used for important communications, such as citations, subpoenas for statements and civil arrest and is mandatory for public bodies and companies (except micro and small companies in Redesim) and optional for individuals.

 

To use DJEN and DJE, you must register on the portal www.jus.br , with a digital certificate or through gov.br (gold account with two-factor authentication).

 

In order to clarify any doubts about the new rules for counting deadlines, we present some explanatory material below:

 


Electronic citation confirmed

The deadline starts on the 5th business day after confirmation of reading.

Unconfirmed electronic citation

Legal entities under public law: the deadline begins 10 calendar days after the summons is sent to the address.

 

Legal entities under private law: the deadline does not start. In this case, the citation must be redone, and the lack of confirmation must be justified, under penalty of a fine.

Other summons and procedural communications

The period begins on the date of confirmation (or on the next business day if confirmation occurs on a non-business day). If not confirmed, the period begins 10 calendar days after the communication is sent.

The procedural deadline begins on the first working day following the date of publication in the DJEN. The publication date is considered to be the day following the availability of the communication in the system.
