General Aspects and Purpose.

 

Mello Pimentel Advocacia (“Mello Pimentel”) is committed to protecting your privacy and, therefore, has defined as rules the provisions contained in this privacy and personal data protection policy (‘Policy’), so that the guidelines on the processing of personal data, in addition to being available and accessible to the holders of personal data, are also clear, all in accordance with the legislation applied in Brazil, in particular Law No. 13,709/2018 (“General Data Protection Law” or “LGPD”).

What do you need to understand?

 

“Personal data” is information that identifies or can identify a person. Examples include full name, profession, identification documents, address, e-mail address, telephone number and level of education, among others.

 

“Data Subject” is the person to whom the Personal Data refers and who is the subject of the Processing.

 

For the purposes of this Policy, the term “Data Subject” refers to you, the visitor and/or user registered on our website (www.mellopimentel.com.br) and other holders of personal data processed by Mello Pimentel.

 

“Processing” refers to any operation carried out with Personal Data, such as collecting, producing, receiving, classifying, using, accessing, reproducing, transmitting, distributing, processing, archiving, storing, deleting, evaluating, controlling, modifying, communicating, transferring, disclosing or extracting such information.

Who does it apply to?

This Policy applies to the Owners of Personal Data processed by Mello Pimentel.

Personal Data collected.

 

The following Personal Data will be collected from Data Subjects: (1) name and (2) e-mail address and/or contact telephone number.

 

The aforementioned Personal Data will be provided directly by the Data Subjects and collected by Mello Pimentel for the following purposes: (1) establishing contact to ascertain interest in legal services, (2) enabling online registration for events promoted by Mello Pimentel, (3) establishing contact for related matters, (4) periodically sending a newsletter and (5) for selecting candidates for internal vacancies.

When you access our site, in addition to the above data, which will be provided directly by you, the Owner, we collect some basic browsing data and information about how visitors use our site, using analysis tools to better understand the interests of our visitors.

 

These tools use “cookies” to collect visitors' browsing information and behavior anonymously, and cannot identify anyone personally.

 

Mello Pimentel will not use Personal Data for any purpose other than those described above.

Responsibility for the Personal Data collected.

 

Mello Pimentel, when it is the controlling agent, will make the decisions regarding the Personal Data processed within the framework of the relationship established with the Data Subject. However, when it is the operating agent, it will process the Personal Data received in order to fulfill the obligations established by the latter and use the data only for the purpose proposed.

 

Sharing of Personal Data.

 

Mello Pimentel will, whenever necessary, share Personal Data with operating agents (who will always process Personal Data in accordance with our guidelines) related to technology service providers and/or with event organizing agencies (related to events in which the Data Subject shows interest).

International sharing of personal data.

 

Mello Pimentel uses cloud systems and, for this reason, personal data is likely to be transferred outside Brazil, such as to the United States of America (USA), which is one of the countries where our service provider's data is stored. To ensure that your Personal Data that may be transferred is processed exclusively for the purposes mentioned, we have adopted guarantees and safeguards, such as specific clauses and standard clauses that must be complied with by our service providers.

 

In these cases, we also guarantee that we only hire third parties that meet the highest security standards, ensuring that the level of protection of personal data is in accordance with Brazilian legislation.

Processing period.

 

The Personal Data collected and processed will be stored until the purpose of the Processing is exhausted or when there is no longer a legitimate purpose or legal and regulatory reason that allows Mello Pimentel to process them.

 

In other words, Personal Data will only be kept for as long as is necessary for the purposes described above, unless there is a legal obligation or for the regular exercise of rights.

 

Security of Personal Data processed.

 

Mello Pimentel adopts the best technical and administrative practices to protect Personal Data against unauthorized access, destruction, loss, alteration, communication or any form of inappropriate or unlawful processing.

 

However, remember that no platform is completely secure. If you have any concerns or suspect that your Personal Data is at risk, please contact us immediately.

Rights of Data Subjects.

 

In accordance with the LGPD, the Data Subject has the following rights:

 

i. Confirmation of the Processing of their Personal Data;

 

ii. Access to their Personal Data;

 

iii. Correction of Personal Data that is incomplete, inaccurate or out of date;

 

iv. Anonymization, blocking or deletion of Personal Data that is unnecessary, excessive or processed in breach of the LGPD;

 

v. Portability of your Personal Data to another service or product provider, subject to our commercial and industrial secrets;

 

vi. Deletion of Personal Data processed on the basis of your consent, except in the cases of retention of Personal Data provided for in the LGPD;

 

vii. Information on who we share your Personal Data with;

 

viii. Information on the possibility of not providing your consent and the consequences thereof;

 

ix. Revocation of your consent to the Processing of your Personal Data, when it is processed on this legal basis; and

 

x. Opposition to Processing that violates the LGPD.

Consent provided.

 

Mello Pimentel collects your consent only for processing related to subscribing to our newsletter and participating in our events. If there is any change in the processing of Personal Data that requires the collection of your consent, you will be informed so that your consent is duly collected in accordance with the LGPD.

 

You are also aware that (i) you may refuse to consent to the processing of your Personal Data for the above purpose, and (ii) you may revoke your consent at any time, without any justification. As a consequence, your refusal or revocation of consent will make it impossible for you to receive our newsletter, since Mello Pimentel will be prevented from processing the necessary Personal Data.

Restriction on processing personal data.

 

Data subjects under the age of eighteen (18) should not provide information through our website. If we become aware that the Data Subject is under 18 (eighteen) years of age, we will delete the information provided and will not keep it in our databases.

Changes to this Policy.

 

We reserve the right to change the provisions of this Policy at our discretion and at any time. Whenever we make material changes to this Policy, such changes shall be valid, effective and binding upon being:

 

- posted on our website;

- sent by e-mail to Cardholders or;

- otherwise communicated to Cardholders.

 

In cases where changes to this Policy result in changes to our Personal Data Processing practices that depend on the consent of the Data Subject, they will be asked for new consent after the change so that they can continue to use our website.
